Necessary documents to get married in Mexico

Moving on, we will tell you about the documents which you should generally apply for at the registry office where you plan to get married, but it is best to check at the registry office to see if you will need to provide any additional paperwork. Or even less.

• Marriage application form according to the format of the Civil Registry, where the ceremony will take place.
• Birth certificates of both spouses.
• Proof of bachelorhood or non-existence of marriages of both spouses.
• Medical certificate issued by an official body documenting the blood type of the bride and groom and certifying that they do not have chronic or untreatable diseases, as well as contagious or hereditary diseases. As this document is valid for 15 days, it must be issued in the days prior to the wedding in order to be legally valid.
•  Permission from the Migration Office of the Ministry of the Interior to get married in this office. You must apply for it in the area where you want to get married.
• Proof of address not older than 3 months in original and copy.
• Proof of payment of fees, the amount of which varies depending on the state.
• Official IDs of both of you and the witnesses.
• If applicable, divorce or death certificate of the previous partner.
• Proof of having attended a prenuptial course as provided for in the Civil Code of the state in which the marriage is to take place.
• Agreement stating the property regime under which they will marry marital partnership or separation of property.
• Proof from REDAM (Register of Maintenance Debtors in Default), of both parties and must state that they are not registered in the registry.

The procedures for getting married in Mexico must be given priority in terms of time, as there are bureaucratic processes that take longer than desired, as well as what you will have to pay in administrative fees.

You should also bear in mind that these documents are only required for civil marriages. Religious marriages do not require these formalities with the immigration authority.

Necessary documents from the resident country

Compiling all the marriage paperwork can already be complex in normal circumstances. Imagine when documentation has to be obtained from afar. If the foreign partner has the opportunity to travel to his or her home country in good time before the wedding, it would be advisable to pay a visit to a notary. For what purpose? If it is difficult for you to travel from one country to another, it would be very practical to sign a power of attorney so that someone you trust can represent you before any civil authority in the place where you do not currently reside. Most documents can only be given to the holders, but with this power of attorney signed before a notary, their representative would be authorised to carry out any procedure on behalf of the person granting the power of attorney. In the case where both the couple are foreigners, you must present your birth certificate legalised by the Mexican Foreign Service. If the birth certificate is in a language other than Spanish, a translation by an expert translator authorised by the Superior Court of Justice must be presented with it.

Apostille and legalisation

Please note that every document issued by a foreign authority in Mexico (e.g. birth certificate or single status certificate) must be apostilled in accordance with the Hague Convention. If the document is issued by a country that is not a signatory to the Hague Convention, it will have to be legalised.

To apostille a document means to certify it with the signature of the corresponding public servants so that the validity of the document is recognised in Mexican territory. This procedure can be requested from the body in charge of the legal legalisation of official documents in your country of origin. If it is also in another language, you will need the services of a sworn translator so that the official translation is valid and can also be apostilled or legalised, as appropriate.

Authorisation to marry a Mexican national

It is necessary to review the legislation in force at the time of integrating your documentation so as not to be confused with the necessary procedures. According to the latest immigration reform, the National Migration Institute no longer has to issue the authorisation that was previously required for a foreigner to marry a Mexican national or a temporary or permanent resident in national territory.

Documentos necesarios para casarse en México

A continuación, te contamos los documentos que generalmente deberéis solicitar en el Registro Civil donde planean casarse, pero lo mejor es que verifiquen en dicha instancia si necesitarán aportar algún papel más. O incluso menos.

¡Aquí van!:

•         Formulario de solicitud de matrimonio según formato del Registro Civil, lugar en el que se llevará a cabo la ceremonia.
•         Actas de nacimiento de los dos cónyuges.
•         Constancia de soltería o de inexistencia de matrimonios de ambos.
•         Certificado médico emitido por un organismo oficial que documente el tipo de sangre de los contrayentes y que acredite que no tienen enfermedades crónicas o sin tratamiento viable, así como enfermedades contagiosas o hereditarias. Como la vigencia de este documento es de 15 días, deberá ser emitido en esos días previos a la boda para que tenga validez legal.
•         Permiso de la Oficina de Migración de la Secretaría de Gobernación para contraer matrimonio en esa concejalía. Deberéis solicitarlo en la zona donde os queráis casar.
•         Comprobantes de domicilio no mayor a 3 meses en original y copia.
•         Comprobante del pago de derechos, el monto de este cambia dependiendo del Estado.
•         Identificaciones oficiales de ambos y de los testigos.
•         En caso aplicable, acta de divorcio o de defunción de la anterior pareja.
•         Comprobante de haber asistido a un curso prenupcial según disponga el Código Civil del estado en el que contraigan nupcias.
•         Convenio que exprese bajo qué régimen patrimonial se casarán: si en sociedad conyugal o en separación de bienes.
•         Constancia del REDAM (Registro de deudores alimentarios morosos), de ambos contrayentes y debe manifestar que no se encuentran inscritos en el registro.

A los trámites para casarse en México hay que darles prioridad en el tiempo, pues hay procesos burocráticos que demoran más de lo deseado, así como lo que tendrán que pagar en tasas administrativas.

Es importante que sepáis que solo los funcionarios oficiales pueden solicitar documentación extra. Para evitar fraudes, haced todos los trámites en instalaciones oficiales del gobierno o asesoraos con abogados que puedan acreditar su experiencia y ética profesional. ¡Nosotros te podemos asesorar con los trámites de tu matrimonio mixto!

También tenéis que tener presente que esta documentación solo es necesaria para el matrimonio civil. Ya que el matrimonio religioso no exige estos trámites ante la autoridad migratoria.

Documentos necesarios del país de residencia

Recopilar todos los trámites de matrimonio ya puede ser complejo en circunstancias habituales. Imagina cuando hay que conseguir documentación en la distancia. Si el miembro de la pareja que sea extranjero tuviera la oportunidad de viajar a su país de origen con tiempo suficiente antes de la boda, sería recomendable hacer una visita a un notario. ¿Con qué finalidad? Si se os es difícil viajar de un país a otro, sería muy práctico firmar un poder notarial para que alguien de plena confianza pueda representarlos ante cualquier autoridad civil en el lugar donde no residen actualmente. Esto les ayudaría a recopilar toda la documentación del país sin tener que desplazarse hasta allí.

Y es que, la mayoría de documentos solo se pueden entregar a los titulares, pero con este poder firmado ante notario su representante estaría autorizado para realizar cualquier trámite en nombre de quien lo otorga. Además, hay trámites que solamente tienen validez legal por un máximo de tres meses.

Y si ambos sois extranjeros…

En el caso de que los dos seáis extranjeros, tenéis que presentar vuestra acta de nacimiento legalizada por el Servicio Exterior Mexicano. En el caso de que esta se encuentre en otro idioma distinto al castellano, deberá presentarse con ella, la traducción realizada por un perito traductor autorizado por el Tribunal Superior de Justicia.

Apostillado y legalización

Considerad que cada documento que presenten en México emitido por una autoridad extranjera (por ejemplo, el acta de nacimiento o el certificado de soltería) deberá estar apostillado de acuerdo al Convenio de La Haya. En caso de que ese documento sea emitido por un país no firmante de dicho tratado, tendrá que ser legalizado.

Apostillar un documento significa certificarlo con la firma de los servidores públicos correspondientes para que la validez del documento se reconozca en territorio mexicano. Este trámite pueden solicitarlo ante la instancia que se encargue de la legalización jurídica de documentos oficiales en su país de origen. Si además está en otro idioma, necesitarán los servicios de un traductor jurado para que la traducción oficial tenga validez y puedan también ser apostillada o legalizada, según proceda.

Autorización para contraer matrimonio con un mexicano

Es necesario que revisen la legislación vigente en el momento de integrar su documentación para no confundirse con los trámites necesarios. De acuerdo con la última reforma migratoria, el Instituto Nacional de Migración ya no tiene que expedir la autorización que antes se exigía para que un extranjero pudiera contraer matrimonio con un mexicano o con un residente temporal o permanente en territorio nacional.

No duden en asesorarse con un abogado especialista en extranjería para evitar malentendidos desagradables. Pregunten cualquier duda más específica tanto en el Registro Civil como en las oficinas del Instituto Nacional de Migración.

Al igual que los requerimientos que implica el matrimonio entre cónyuges mexicanos, es recomendable que al momento de acudir al Registro Civil para verificar la disponibilidad de fechas, también se solicite a detalle toda la información que debe proporcionarse y así evitar sorpresas de último minuto.
